Q. I’ve received a planning enforcement notice — what is it and what should I do?

A. Planning authorities have the powers to serve enforcement notices where a breach of planning control has occurred (eg, something has been built without permission). Enforcement notices are served on the owner and the occupier of the land as well as anyone else who has an interest in it.

The notice will set out what the alleged breach of planning control is, what steps are required to be taken to remedy it or the impact on amenity arising from the breach, and by when those steps must be taken. The period of time given must be reasonable.
