Judge rules former president ‘engaged in insurrection’ in relation to the Capitol riots but throws out lawsuit
Donald Trump hailed a “gigantic court victory” after a judge in Colorado allowed him to remain on the state’s ballot paper next year by throwing out a lawsuit claiming he should be barred for his involvement in the insurrection at the US Capitol.
Judge Sarah Wallace found that Trump “engaged in insurrection” by inciting his supporters to attack the US Capitol, but ruled the 14th Amendment to the Constitution banning insurrectionists did not apply to a president.
It follows similar rulings by courts in Minnesota and Michigan that rejected efforts to keep Trump off the Republican primary ballot but have not ruled on his eligibility for the November 2024 general election.
